Conditions of Sale

1 - General Conditions

The General Terms and Conditions of Sale, as detailed in this document, take on the form of an exclusive contractual relationship between:
  • the registered Customer/User, hereafter designated as User, and
  • the website, owned by the ZEE, SA company, with headquarters in Cascais, registered in the Commercial Registry, under no. 485/2008, hereafter designated as Site.
The present Conditions of Sale, in conjunction with the Terms and Conditions of Use, are the only dispositions applicable to the whole of the use and purchase relationship between User and Site, except for cases where different conditions have been agreed to between the parties, expressly and in writing.
ZEE can, at any time, modify these Conditions, with immediate validity upon their publication on the Site, thereby nulifying and substituting the previous version. Please review these conditions periodically to guarantee that you are aware of and agree to the conditions in force at the time of your interaction with the Site.
When using the Site, and in particular when placing an order, the User is declaring his/her agreement to the present Conditions of Sale and to the Terms and Conditions of Use, and is therefore bound to respect their respective clauses.

2 - Ordering Method

All orders by users must be made using the order placing mechanisms available on the Site, www.yourZEE.com, which represent the only accepted method. For all orders received on the Site, a confirmation Email will be sent to the User with the data of the respective order.

3 - Order Acceptance

Zee reserves the right to reject any order for objects whose personalisation has used:
  • Content protected by copyright by entities other than the User;
  • Content that by their illegal or offensive nature can not be accepted (eg.: xenophobia, racism, pedophilia, violence, etc.).
  • ZEE Logo without complying with the internal rules of presentation and use.
All orders received will be submitted to a process named “Human Filter” that will determine their acceptance or rejection. The amounts previously paid by the User, relating to a rejected order, will be credited, in their totality, to his/her Account in the user area of the Site. If you used a ZEE voucher, the voucher code is automatically enabled, so you can use it next time your order a ZEE.

4 - Order Status

Immediately following the respective payment, an order will assume and maintain a “Waiting Approval” status until the Human Filter validation decision is made. Depending on the result of the decision, the order will pass to a “Rejected” or “Accepted” status.
An order can be cancelled by the User while in the “Waiting Approval” status, with its value being credited to the respective User’s Account. Immediately following the beginning of the production of the object, the order status will pass to “In Production”. Upon conclusion of its production, the order will be processed for delivery to the address indicated by the User, and the order status will pass to “Expedited”. Orders in the “In Production” or “Expedited” status cannot be cancelled by the User.
At any time the User can consult the status of his/her order by accessing the "Acquired Watches" menu.

5 - Prices

All sales prices (and all other monetary values) indicated on the Site are expressed in Euros and include the VAT at the legal rate in force in Portugal. The shipping costs are the responsibility of the User and are calculated at the end of the order, in function of its constitution (number of objects) and country of destination. You can consult the Shipping Costs table on the Site.
Countries outside of the European Union may apply Customs Charges when importing the products. ZEE does not control, nor have knowledge of the applicability and the values of these charges, which may be applied when the merchandise arrives in the country of destination. To find out if Customs Charges will be applied in your country, please consult the respective Customs Authorities.

6 - Delivery Deadlines and Methods

ZEEs will be delivered 10 working days after order acceptance. These deadlines may be exceeded in cases of force majeur (total or partial labour srike, delays in the postal or transport service, fire, flood, earthquake, war, among others). Deliveries will be made by a delivery service contracted by ZEE. Delivery times are indicative and, therefore, are considered valid when no physical or structural impediments exists (for example: incorrect addresses or situations of force majeur). In the case where the order is not received within the stipulated deadline, an investigation will be carried out with the transporter to identify the cause. The User should contact ZEE, by filling out the form in Contact Us, mentioning the fact that the respective order has not yet arrived and the deadline for its delivery has passed, so that ZEE can initiate the investigation process with the corresponding shipper. During the period of this investigation no refund can be made, given that the cause for the delay needs to be identified and confirmed. In the case of a product received with defects, the customer should send an Email to Customer Support Service.
ZEE does not take responsibility for any transport related problems that occur after the transporter has delivered the order. Note that ZEE may refuse any request for refund or substitution (right of retraction) for products with external defects that were accepted by customers upon delivery. The right of retraction remains valid for cases where technical problems are detected by the customer after delivery and in accordance with the terms prescribed by the law. The process that should be followed by Users when receiving a delivery is the following:
  • Verify that the packaging is in a perfect state and that it does not present any visible damage.
  • Ask the delivery person to wait while you open and verify the contents of the package (this is a customer right).
  • Verify that the product conforms to your request and that it does not present any visible defects. If everything is in order, accept the delivery.
  • If there is a problem, ie. a mistake in the requested product, or a defect or visible damage, refuse the delivery and fill out the form available for these situations, describing the issue.
  • Reassemble the package and give it to the delivery person.
  • Notify ZEE as soon as possible of the incident, mentioning the reason for refusal of the delivery.

7 - Payment Methods

Payment terms are defined exclusively by ZEE in accordance with its commercial policy and shall be accepted by the User before placing an order. Except when paying via Multibanco (Portugal only), all other payment types will be processed by PayPal, and payment methods accepted by this entity may be used (Visa, American Express, MasterCard, Discover and PayPal account). The User accepts that his/her data will be submitted by him/her to PayPal for transaction processing. ZEE does not provide PayPal with any User data. When it is time to make a payment, the Site transfers the control to PayPal, with the amount to be paid. The transaction will occur between the User and PayPal, with ZEE receiving, at the conclusion of the transaction, information of the amount transacted and if the payment was confirmed.

8 - Guarantees

Every ZEE delivered has a 5 year guarantee against factory defects. This guarantee becomes null and void if the equipment presents signs of misuse, mistreatment, etc. The guarantee begins at the time the equipment is delivered at the destination specified when placing the order. Any and all exchanges or returns can only occur with the express authorization by ZEE, who will at that time indicate the process to follow. It is the User’s responsibility to observe the instructions and information relating to the use of ZEE watches, namely:
  • Water resistance: If “water resistant” is not written on the back of the watch, then the watch is not protected against water, thus the User should take special care not to wet the watch, given that water may damage the proper functioning of the watch.
  • Temperature limits: Your watch functions with stable precision between 5º and 35º Celsius (41º and 95º Fahrenheit). Exposure to high temperatures (above 60º Celsius or 140º Fahrenheit) may damage the components and shorten the battery life. Do not expose your watch to very low temperatures for long periods of time, given that the cold can provoke deceleration and acceleration of the watch’s hands. However, these situations will be overcome once the watch returns to its normal temperature.
  • Impacts and vibrations: Slight vibrations may affect the proper functioning of the watch. Also, be careful to avoid hitting the watch against hard surfaces, as this may cause damage to the watch.
  • Magnetism: The watch is affected by high levels of magnetism. Contact of the watch with magnetic objects may provoke deceleration or acceleration of the watch’s hands. However, the normal precision of the watch’s hands will return once the watch is removed from the magnetic fields.
  • Chemicals: Be careful not to expose your watch to solvents, mercury, cosmetic sprays, detergents, adhesives or paints, as the watch components may become discouloured, deteriorated or damaged.

9 - Litigation and Responsibility

The resolution of any and all litigation resulting from the interpretation or execution of these General Conditions shall be the competence of the Court of the District of Loures, Portugal. ZEE does not take responsibility for delays or nonfulfilment of contractual obligations for reasons of force majeur, disorder, total or partial labour strikes, postal, transport or communication services, flood, fire or war. ZEE does not take responsibility for any indirect damage, loss of exploitation, loss of benefit, loss of opportunity, damages or taxes that may occur from the purchase of any product presented on the Site. Our products are intended for personal use. Therefore, ZEE cannot have its responsibility compromised by any loss that results from a professional activity.
